Amory Waters Dismissal and press release..

After more than a year of agony, a Fond du Lac family whose son was accused of rape is ready to heal. "It's been extremely traumatic," said Renee Waters, mother of 22-year-old Amory Waters, who was accused of rape 13 months ago in Dane County. "I don't wish this on anyone." In September 2014, Waters was accused of sexually assaulting a woman in an alley on the University of Wisconsin-Madison campus in the early morning hours of Aug. 22, 2014. He told police he had been playing a drinking game that night at the Kollege Klub on North Lake Street and didn't remember anything after that, according to the criminal complaint. He was charged in Dane County with felony second-degree sexual assault. The woman told police she was raped by a stranger, even though the man knew her name and told her, "It's OK, (victim's name), I know you." Traffic camera video showed the woman leaving Wando's on University Avenue around the same time Waters was seen walking on North Lake Street. The video shows the woman was near Waters at the time he crossed University Avenue. The case hinged on identifying Waters and the accuser in the grainy video clip that was less than three seconds long, said Assistant District Attorney Corey C. Stephan at the Oct. 8 hearing in Dane County, where the case was dismissed. Also, two DNA samples found on the woman's clothes did not match Waters' DNA, Stephan said, and a statement Waters made characterized as an admission of guilt was later determined to be an admission of not knowing what happened during a night of drinking. Stephan said he could not prove the case beyond a reasonable doubt, according to court documents. "I think if I try this case five out of five times, I think I would lose it five out of five times and would be, frankly, surprised if I even won it once," Stephan said. Though the woman appears to have been sexually assaulted, Stephan said, the evidence did not point to Waters as the perpetrator. Stephan is satisfied with the investigation. "I think it's fair to say that no stone was left unturned in the investigation." Meanwhile, the Waters family is struggling to pick up the pieces. Renee Waters said the price of innocence has been steep. "Because of this experience, I have changed my total world view of our justice system," she said. "(The case) caused great distress to the innocent parties, his family and friends, not to mention the tens of thousands of dollars in legal fees." A second-degree sexual assault charge against Amory J. Waters, 22, was dismissed by Dane County Circuit Judge Stephen Ehlke at the request of Deputy District Attorney Corey Stephan. At a hearing Thursday, Stephan told Ehlke that the case hinged on identifying Waters and the woman in a 2.5-second video that was so poor he wasn’t sure he could identify the victim in it. Stephan also told Ehlke that the actions of the individuals in the video didn’t match the woman’s statement, two DNA samples found on her clothes were not from Waters, and a statement by Waters initially characterized as an admission of guilt was actually a concession. “I have come to the conclusion that we cannot prove this case beyond a reasonable doubt. I think if I try this case five out of five times, I think I lose it five out of five times and would be, frankly, surprised if I won it once,” Stephan told Ehlke. Waters, who is not a student, was accused of raping the woman in the early morning hours of Aug. 22, 2014, in an alley alongside a parking ramp between the 10 block of North Park Street and East Campus Mall. Waters was arrested by UW-Madison police after a voluntary interview, according to his attorney, Chris Van Wagner. A criminal complaint said Waters was identified by the clothing he was wearing and was seen in the area on traffic cameras. But Van Wagner said there was no evidence connecting Waters to the woman, especially after the woman began having trouble remembering much from the incident in recent weeks. “They used his shoes that were spotted in a video (as evidence) and his loss of memory as corroboration, until we demanded a trial,” Van Wagner said. According to the criminal complaint, the woman told police she was raped by a man she did not know but that the man knew her name and told her, “It’s OK, (victim’s name), I know you.” But investigators found no evidence that Waters and the woman knew each other, Van Wagner said. Investigators were still waiting for results of DNA testing when the criminal complaint was issued, but Stephan told Ehlke that evidence found on one of the shirts the woman was wearing was connected to two men and not to Waters. He also told Ehlke that another shirt the woman was wearing was given back to her by accident after her medical examination and she laundered it before DNA evidence could be taken from it. The criminal complaint also said that police used traffic camera footage to spot a man fitting the description of the assailant walking south on North Lake Street from Langdon Street about 1:17 a.m. It said that video showed the woman leaving Wando’s, 602 University Ave., around the same time and she was near her assailant at the time he crossed University Avenue. But the video was grainy and showed only the lower legs of the woman and the pants and shoes of the man fitting the assailant’s description, Stephan said. That made it difficult to positively identify the woman in the video or prove that the shoes worn by the assailant in the video were the same shoes found at Waters’ apartment, he added. “It ultimately all came down to that identification of the shoes,” Stephan told Ehlke. The criminal complaint said after Waters identified himself in a photo sitting at a bar at the Kollege Klub, he got emotional during the police interview and said that if the police had proof, then he must have done it. He said he couldn’t remember anything about that night after playing a drinking game at another bar earlier in the evening. But after watching tape of the interview, Stephan said Waters didn’t know what he was being accused of and made a weak admission at best. “So I think ultimately, that admission would not carry the day in court, particularly considering the dearth of other corroborating evidence,” he added. Waters’ mother, Renee Waters, of Fond du Lac, said her son never should have been arrested. “If this could happen to my son, who is innocent, where there was no evidence proving otherwise yet we needed to spend $40,000 for a lawyer to help him, what’s happening to (other) kids who can’t afford $40,000 for a lawyer?” she asked.

...Avory's sad, scarey jail stay...

Avory's sad, scarey jail stay... Yes... the two campus detectives arrested Amory with the evidence they had in front of them...which wasn't much..a description of shoes and a red T-shirt and being in the vicinity where the crime happened oh yes.... so now the scarey part begins... Avory had no prior police record, actually had no run ins with the law at all, so can you imagine how he felt when the detectives were questioning him on this very severe and sensitive subject. { scared out of his mind, shaking, tense, numb, balling etc...} Avory was cuffed and brought to a holding cell--All Avory could think of was...are these men going to beat the livin day lite out of me when they find out what I am in here for ..Amory's Blood Pressure was well over 190--heart was beating out of his chest. Avory had the choice to have his own cell or go into the pods with the other guys...he thought maybe it would be better for me to be with people right now because my mind/sanity isn't doing so well right now. Avory's hand cuffs were really tight so he was not able to sleep very good that night, but he tried because he knew the next day his mug shot and hands were going to be printed for everyone to see so he tried to get some sleep. That night a CO came in and checked on him every couple of hours because his blood pressure was still very high and even into the next day Avory was being monitored. Avory was issued a top bunk in the pod, Avory was really having a hard time with the fact that he could not remember what happened that evening on his 20 minute walk home when the crime happened, he thought of all kinds of scenios that he thought could've happened, what he might do--did he leave KK's with anyone, the detectives would not tell him anything-- just made it sound like he was guilty and that they had proof of him doing this crime. This really upset Avory so much that he asked for a psyhe nurse to talk to...The nurse asked how he was doing with the media coverage following this case--Avory said what..media coverage..that sure doesn't make me feel any better..Avory asked the nurse do you think with this being my first offense that I will be out on a signature bond..The nurse said "Oh no..you won't get out of here for a long time..by the way, do you have any suicidal thoughts?" Avory was trying to get a hold of his arresting officers to tell them some of the things he was thinking...maybe try to explain what might've happened and to explain the kind of person he was--that he could nor--- would he ever committ a crime like that even if he was drunk..that ..that is just not my character.. When the arresting officers came..it was during a football game and they were working at it...they listened to what Avory had to say..of course they didn't right any of that down but instead said..you mean you called us over here to tell us this...this is a waste of our time!! Avory tried to keep hir composure..it didn't look like anyone was going to help him...he just needed to wait... a whole lot more happened after this...to much to even write about.

Madeline's Crime.

Detective O'Peale brought Madeline in for questioning friday night around 5:30 pm. questioned her about her where about's on the afternoon of Oct 6 Madeline said: I was playing bridge with the girls at KK's house and I had too many Manhattan's and I can't remember anything after that Detective until later when I barfed all over Janies new bathroom carpet. Well we have your black bag and White shoes on camera and you are our only suspect that matches the description the victim gave that afternoon concerning the mystery of the stolen book and since you were at KK's house which is just down the street from where the book was stolen--we figured it had to be you who took the book...just tell us madeline that you have this problem...you know...problems with stealing books... Madeline: I don't have a problem stealing books.. Detective: Just tell us Madeline..it's ok.. I need to wrap this case up tonight my boss is coming down on me to arrest someone and you are our only lead so far..just tell us you did it so I can go home and watch the game... Madeline: What did I do anyways ...I don't remember anything after I left KK's-- I was 6 shades to the wind that afternoon. I was celebrating my divorse..I said I don't remember a thing... Detective O'Peale: Well we have a court ordered DNI and we need to confiscate your phone for evidence...you know to look for any stolen books, or key chains or book markers that you may have taken recently... Madeline: That's fine..I would never do something like that..my mom taught me to check out books from the library not to steal them.. Detective O'Peale: Well Madeline what should we do with you tonight? I don't know if you believe in God..but where would he want you to go for doing this crime?? Madeline: Well I could say I am sorry to the girl who I stole the book from. Or I could do community service work or I could go into the schools and tell them not to steal books because being questioned by detectives is no fun.... especially on a friday night!! Or I could stay at one of your houses tonight so you could watch me... Detective O'Peal: I don't think that's going to happen Madeline. Detectives went out and conferred with themselves and decided to arrest Madeline for stealing the book... Madeline's crime story---to be continued---

I just finished reviewing all of Amory's video's for the 3rd time and all I see is a very scared boy trying his hardest to cooperate with the detectives who over and over says..I did not do it..I would never do that and I do not remember doing that (crime)...to the point of utter exhaustion, despair and hopelessness. Will you please pray for discernment concerning this case today? Please pray for Judge Stephen Elke, District Attorney Cory Stephen and our lawyer Chris Van Wagner and the jury that they will see and be able to discern the truth and nothing but the truth and that my son is completely exonerated and vindicated..In Jesus name we pray...will you stand in agreement and pray this prayer with me now??

A year ago my son was arrested for an injustice in Madison and this completely devastated me and also my family..We were heart broken..we could not believe what was going on, why this was happening to my son and our family..the crime he was accused of was completely out of character for him.. I knew that he was innocent. but I had to find out why he was arrested in the first place...and I must say this has led me on a long and winding road for which I will not be talking about at this time, but I will say Satan is behind this whole agenda...and instead of falling, accusing God or blaming God for this..Instead..I am lifting my hands to the heavens in Praise and Honor of HIS name... I know he lives....This is a poem I have wrote in honor of my Lord and Savior..Amen.. I am a soldier for the Lord and their is a great war amongest us..we must hold true to our principals and our morals no matter what.. What Satan mean't for destruction, family, reputation... & Morality....Honor has exposed the lies and also the corruption. What Satan mean't for financial ruin..rape and destruction...God has solemnly blessed us with spiritual and material blessings, that will eventually far out weigh what was so unjustly stolen and plundered from us.. Saten tried to defame my son's and our families reputation with lies and theivery and he was met and halted by God's sword of truth... With God,all things are possible, now my tears are tears of joy, my strength is that of wisdom & knowing that God is the most Soverign, Almighty, Glorius King of all and I will never, ever curse my Lord & Savior and die for lack of wisdom. This trial has been an exceptional test of our faith, on all levels seen and unseen. It has affected our mental, emotional, spiritual and physical states of mind.. This tribulation (injustice) has tested our family to the limit, to almost our breaking point and almost... broke my son!! but..Just like the saying "whatever does not kill you (take all that you have and then some) WILL MAKE YOU STRONGER!!! A crime happened on the UW Campus in Madison in October of last year and the victim gave the description of a young lad whom she believed did it. She gave a description of a plain red shirt, cacky pants or shorts and nike tennis shoes, no jewelry, 5"11 to 6'2 brown hair, unshaven young man in his early 20's. The girl did have a rape exam done and was asked questions. The detectves secured the area to look for evidence. The detectives went right to work to look for suspects with a red shirt, cacky pants and Nike tennis shoes. The detectives were able to secure a video of a young lad back paddleing (walking backwards in front of the girl) and the girl was seen in the video following him--walking straight towards him..now if I was the detective I would've scrutinized this video and asked myself several questions 1. this girl does not look scared, she is walking towards him..looks like she knows him. does not hestitate or stops to pull out her phone that she does have on her or even tries to get away to the 3 other exits that she could've taken to get away from this person. so right away I would say that she is not afraid of him..and maybe makes a decision to be with him...but we do not know anymore about what happened than what is on this video rignt now.. ok now let's try to find the person who did this crime..well we will look at the video's in all the bars that night around that time and look for young men wearing a red shirt and tennis shoes, now we will look at the overhead cam's on the streets..and see what we can find. well we find a young man with a red shirt that says (WISCONSIN BADGERS) on his shirt. we also see that he is wearing cacky pants and also tennis shoes..he isn't 5'11-6'2 but he is a close enough match..let's bring him in and question him. and then the detectives question him.. Josh, A man who was wrongly accused for a crime that he did not committ almost a year ago now..and it seems like he was arrested based on what he said in the soft interview room that night of Oct 12? I was trying to explain how it would feel to be questioned by detectives when you are extremely afraid and especially whatever you say to the detectives they are saying that they do not beleive you and that you must know more..because of the fact that your memory is so good and that you can remember everything that happened before the crime and everything that happened after the crime but the 20 minutes you took to walk home that night you seemingly cannot remember that time frame..and I would just say..well if I was drunk and feeling like I was going to throw up and nothing exciting happened that night toooo remember. I did tell the detectives that normally when I walk home, I do not talk to anyone. I just keep my head down and walk home. but this is how I felt when being questioned by the detectives that night...and tell me do you think that you would be able to keep your cool when being questioned???? Imagine yourself being interogated by two military officers that are trained in coeherison, they know political tactics and how to get you to say what they want you to say. They show you pictures of yourself walking and coming out of a place but they do not tell you anything about really why you are being questioned..you have no idea or recollection of the crime you now figure out that they want to arrest you for..they keep telling you that they donot believe you when you try to tell them your story and what you recollect.... You are feeling more and more despondant, your blood pressure has now reached 190, your hands and arms are tingling, you are shaking incessently, you can barely sit in your seat, you are crying--sobbing because you donot know what to do..the detectives continuelly say that they donot believe your story and what you recollect..you know you were drinking that night..and this evens makes it worse..because you know that you may..have done something that you do not remember-- that you did..at least..you know that it is a possibility.. and you entertain all sorts of thoughts and you say them out loud..you ask questions..what does the girl look like? does she know me..what is her name? The detectives say that they cannot divulge that information to you because it is to early in the case and you believe them and you sink even further in your seat and now are very dissappointed in yourself for not remembering what happened that night in that 20 minute period while you walked home that night in Madison.WI on a busy street where there were many people out that night at approx 1:30 that morn. Well..think of what creature you are most afraid of and then think of a detective or police man who has the authority to put you in jail... bring those creatures in the room where you are sitting and then start asking you questions about an event that happened 2 weeks ago..and they so cleverly take the spiders out of their cages one by one and place them around the room and a few on your legs while continuelly in a low compassionate voice ask you questions and tell you that what you answer they do not believe..then finally what you are deathly afraid of (are snakes) and they pull one out and put it around your neck..and you become paralyzed with fear..you can barely answer the questions they are asking you..you try..but all kinds of thoughts are entering your mind now..and you become confused..not sure..because you donot remember anything happening that night when you walked home but the detectives keep saying that you do and they want you to tell them what you know..you finally cry out and say I do not remember anything like that happening that night.. and when you get to heaven you can even ask God and Jesus if I did this..nothing seems to be working..the detectives do not believe you and you know you are ficked!! the detectives ask you to sign the paper of you walking down the street and the one where you ID'ed what looked like the shoes you were wearing that night..The detectives ask you where would the girl want you to go and what should we do with you tonight..you are so exhausted you give the detectives a couple of answers and one is..well I could come over to your houses and you could watch me for the night..smile..well the detectives do not like that idea..but I think they can see that you are in no condition to go home either..they know that you are not thinking correctly and that you are in the pit of despair..and question your sanity at this time..but they donot call your mother or friend to come and pick you up either..instead they arrest you..and hand cuff your wrists tightly so tight that you have to later ask the guard to loosen them up for you...you are put in a cell by yourself and are being monitored because your blood pressure is so high and they are worried about you..I hope anyways!! to be continued...

At our Status Conference today C.S. (District Attorney) did not show up!!..Gee..If my son wouldn't have showed up. Their would have been a warrant out for his arrest!! Thank God the judge did his job and made C.S. be present for "THE RECORD"...This case has had one mistake after another..Our Lawyer thinks the DA has not even read the full report or even looked at the videos---hence that is why their could be no dismissal--I figured from the start--if the District Attorney C.S. did not have 1-2 hours to review our case and write up his findings--He sure as heck is not going to prepare for a trial that takes hours upon hours to get ready for..and our lawyer today said C.S. record for taking people to trial is almost Nil.. This is a high profile case--it has been all over the news, radio, internet and newspapers from Milw all the way up to Rhinelander.. Our Lawyer said "they needed" to arrest someone to make the WU parents of kids feel safe.--I know for a fact that this is true because of others things the detectives tried to do to my son.. I will end my remarks here..the trial is scheduled for Oct 12th..

"What?! $9,500?!" Obama asks, stunned, "But you said it's an easy repair. Michelle will kill me if I pay a plumber that much!" Troy says, "Yes, but what I do is charge those who make more than $250,000 per year a much higher amount so I can fix the plumbing of poorer people for free. This has always been my philosophy. As a matter of fact, I lobbied the Democrat Congress, who passed this philosophy into law. Now all plumbers must do business this way. It's known as the 'Affordable Plumbing Act of 2014'. I'm surprised you haven't heard of it." In spite of that, Obama tells Troy there's no way he's paying that much for a small plumbing repair, so Troy leaves. Obama spends the next hour flipping through the phone book calling for another plumber, but he finds that all other plumbing businesses in the area have gone out of business. Not wanting to pay Troy's price, Obama does nothing and the leak goes un-repaired for several more days. A week later the leak is so bad President Obama has had to put a bucket under the sink. Michelle is not happy as she has Oprah and guests arriving the next morning. The bucket fills up quickly and has to be emptied every hour, and there's a risk the room will flood, so Obama calls Troy and pleads with him to return. Troy goes back to Obama's house, looks at the leaky pipe, checks his new rate chart and says, "Let's see, this will now cost you $21,000." Obama quickly fires back, "What? A few days ago you told me it would cost $9,500!" Troy explains, "Well, because of the 'Affordable Plumbing Act,' a lot of wealthier people are learning how to maintain and take care of their own plumbing, so there are fewer payers in the plumbing exchanges. As a result, the price I have to charge wealthy people like you keeps rising. Not only that, but for some reason the demand for plumbing work by those who get it for free has skyrocketed! There's a long waiting list of those who need repairs, but the amount we get doesn't cover our costs, especially paperwork and record-keeping. This unfortunately has put a lot of my fellow plumbers out of business, they're not being replaced, and nobody is going into the plumbing business because they know they can't make any money at it. I'm hurting too, all thanks to greedy rich people like you who won't pay their 'fair share'. On the other hand, why didn't you buy plumbing insurance last December? If you had bought plumbing insurance available under the 'Affordable Plumbing Act,' all this would have been covered by your policy." "You mean I wouldn't have to pay anything to have you fix my plumbing problem?" asks Obama. "Well, not exactly," replies Troy. "You would have had to buy the insurance before he deadline, which has passed now. And, because you're rich, you would have had to pay $34,000 in premiums, which would have given you a 'silver' plan, and then, since this would have been your first repair, you would have to pay up to the $21,000 deductible, and anything over that would have a $7,500 co-pay, and then there's the mandatory maintenance program, which is covered up to 17.5%, so there are some costs involved. Nothing is for free." "WHAT?!" exclaims Obama. "Why so much for a puny sink leak?!" With a bland look, Troy replies, "Well, paperwork, mostly, like I said. And the internal cost of the program itself. You don't think a program of this complexity and scope can run itself, do you? Besides, there are millions of folks with lower incomes than you, even many in the 'middle class', who qualify for subsidies that people like you must support. That's why they call it the 'Affordable Plumbing Act'! Only people who don't make much money can get it. If you want affordable plumbing, you'll have to give away most of what you have accumulated and cut your and Michelle's income by about 90%. Then you can qualify to GET your 'Fair Share' instead of GIVING it." "But who would pass a crazy act like the 'Affordable Plumbing Act'?!" exclaims the exasperated Obama. After a sigh, Troy replies, "Congress ... because they didn't read it."
